During a 2022 building plan submission process the Breede Gouritz Catchment Management Agency (BGCMA) indicated that all developments within a wetland as indicated on the National Wetlands v5 map, require authorization from the BGCMA before construction. The applicable legislation requiring the authorization is cited in the National Water Act,36 of 1998: S21c&I water uses:
S21c – Impeding or diverting the flow of water: whether surface or groundwater (through foundations and infilling);
S21i – Altering the bed, banks, or characteristics of a watercourse. (This means any characteristic of the watercourse, of which a wetland is part of, that would be changed or altered by the proposed building.)

The authorization Process
A South African Council for Natural Scientific Professions (SACNASP) accredited professional must complete a Risk Matrix and submit this to the BGCMA for the proposed development. The EMS officials are not SACNASP accredited and therefore cannot conduct site visits to verify the presence or absence of a wetland or complete the Risk Matrix required for submission to the BGCMA for the proposed construction.
